The Board of Zoning Appeals is a group of citizens who meet as needed to determine if exceptions or variance may be given to the requirements of the Zoning Code. The Board of Zoning Appeals is a public meeting and by Ohio law, the public must be notified so that anyone who has an interest in objecting to any exceptions to the Zoning Code may be at the public meeting.

FILING PROCEDURE FOR ZONING APPEAL

The Zoning Board of Appeals meets on an as-needed basis

The following is the procedure for filing an appeal of a notice, order, denial and/or interpretation issued by the Village Building Official in regards to the Village of Fairfax Zoning Code.

  1. Fill out an “Application for Appeal” addressed to the Village of Fairfax Board of Zoning Appeal stating the basis for requesting the variance.
  2. Names and addresses of all adjoining property owners; this includes those across the street from said property as shown on the County Auditor’s records.
  3. Three {3} copies of plot plan and/or plans of improvement proposed, including the existing and intended use of each building or part of a building.
  4. Check payable to the Village of Fairfax: Residential applications – $110.00; Commercial applications – $313.00
  5. Mail or deliver above noted items to:

This request must be made within 30 days from the date of notice, order, denial and/or interpretation of the Village Building Official. The request will be heard by the “Village of Fairfax Board of Zoning Appeal” on a date and time established by that Board.

Decisions of the Board regarding matters of the Zoning Code can be appealed to the Court of Common Pleas of Hamilton County, Ohio. Such appeals must be made within 10 days of the date of the order of the Board.
